The Adams Files by Randy Adams

Los Angeles, CA - The tragic, and unnecessary death of a Sacramento woman trying to win a Nintendo Wii for her family by drinking massive amounts of water as part of a radio station promotion should make all of us take a step back and review our contest procedures.

Because, even though disclaimers are aired and waivers are signed, if the participant doesn’t realize there is a danger- and most would not have thought drinking water could bring death- stations are not off the hook and could be held liable.

I’ve seen contests that were great ideas on paper fail miserably when executed. One time, a station dropped 1000 ping pong balls from 50 feet in the air. All were numbered. One of the numbers matched a number inside a car dealership showroom and that person would win a brand new car.

Talk about a free-for-all. The wind picked up considerably during the three hour remote, and when the balls were dropped, many floated out of the parking lot, and into the flow of traffic in front of the dealership. There were about 3000 people trying to grab 1000 balls, and even though you were only supposed to get one per person, people were taking six, seven, eight of them, and giving them to family members. The faster and bigger you were in this contest, the better chance you had to win. Needless to say, too many complaints, a fairly serious injury, and the threat of a lawsuit negated the whole thing- and the winner didn’t get the car.

Many stations have given away vehicles to those who can keep their hand on the car the longest. Great, if you are physically capable and can have somebody hand feed you and put a portable tent around you when you need to use the facilities. But there are many stations who have been sued for instances where a person falls asleep, bumps another person off accidentally, and removes them from chances of winning the car. Other people have been known to be hospitalized due to various ailments after standing for seven days in a row. Some stations allow 15 minute breaks every three hours for contestants in various forms of this "contest", but the chances of it being a winner for your station are slim….only one person wins the car, a few others are sore, tired, or worse when it’s over, and it’s not worth the risk of a lawsuit. Same with the stand-by "how many people can you fit in a ______". Neck or back strains can, and will happen.

Contests that involve stunts need a very close once over and review from a legal counsel, preferably an attorney who specializes in entertainment law. Though your promotions director can write a simple waiver for somebody to sign, that waiver needs to include all that COULD happen during an event. And the waiver needs to be reviewed by your attorneys.

For instance, we had a contest one year where we "Dodged" the tax man by having folks stop by a local dealership on tax day, April 15th, and donate a dollar, or three swings for five dollars, with a sledgehammer and basically demolish a Dodge Neon. We had waivers that specifically included all that could happen, including back and neck injuries by swinging the sledgehammer, dropping it on your foot, or ignoring signs posted in the area to stay clear of the "swing" area. Obviously, we make sure all of the glass was out of the vehicle and off of it- that said, everything from turn signals to gear shift knobs can fly up and hit people. We covered our bases on it, and raised a lot of money for charity. Our contestants wore a helmet and a protective mask.

What puzzles me is that this station in California is in a top 30 market, and one of their listeners called during the contest to warn the morning team about "water intoxication". The jocks decided not to heed her warnings, and a woman died doing something that on air, and on paper, looked like it would be harmless. It seems reckless to me- not just the on air talent, but those in promotions, programming, any department that was involved- someone should have taken a look at the worst case scenario and either scrapped the idea or amended it to avoid this tragedy from occurring. With all of the structure corporate radio screams it has, many dropped the ball on this one, big time.

As a programmer in a major market or a one horse town, what you do on air and off air is subject to scrutiny and there’s always the person who is looking for easy money by finding something that they can exploit. I certainly don’t mean to infer that Jennifer Strange did this purposely. My sympathies go out to her husband and children and entire family. What I am saying is contests need to be assessed every time before you launch one, stations should cover their legal bases and insurance situations, and if it seems like there still is a risk to a listener, which in turn can do no good for a station whatsoever- it’s probably best to shred that idea and come up with something less risky. They say that even bad press is good press. It certainly wasn’t in this case, was it?

SongU.com Members Celebrate January Success

This weeks quote:
"I want to thank you again for this website! It has opened up unbelievable doors for me that simply would have never happened without it!" - quote submitted on 2/1/07 by SongU.com Member, Gene R.

Hi Everyone,

It's getting cold here where we live, so I hope you're staying warm this February! We had our first bit of snow here on Friday morning. Our 4-year old daughter, Mia, was very excited when she got to make her first snowman and I broke out the rarely used sled and pulled her around the yard.

Things have been pretty exciting around the SongU.com campus as well. Classes are running almost every night of the week including our new track of feedback classes where members bring songs in progress to have them evaluated by our hit songwriting faculty. We also had a special lunchtime e-Seminar with songplugger extraordinaire, Cole Wright, who gave members an opportunity to hear some of the uncut songs of the top pro-writers he is currently pitching. We also kicked off our "Blind Date" challenge where we hook up potential co-writers to write a song together. And our special "connections" feature continues this month with ASCAP songwriter rep, Chad Green, stopping by to talk to members on Feb 13th in our e-Auditorium. Chad will also be listening to members' songs this month in Spin N' Pitch.

Speaking of Spin N' Pitch, our SongU.com members proved once again that it pays to work on your craft and make your songs great. Read on...
